Acceptance of Terms
These Terms of Use govern your use of NearLens, the iOS application published by Marcos Rezende ("we", "us", or "NearLens"). By installing or using the app, you confirm that you are at least 13 years old and that you accept these terms.
If you are using NearLens on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
License to Use
We grant you a personal, non-exclusive, non-transferable, revocable license to use NearLens on Apple-branded devices you own or control, subject to these terms and the Apple App Store Terms of Service.
This license does not include:
- The right to sublicense, sell, or redistribute the app
- Access to the app's source code beyond what is already published under our open-source license (AGPL-3.0)
- Any intellectual property rights not expressly granted here
NearLens is free to download and use. We reserve the right to add paid features in the future; any such features will be clearly labelled.
What NearLens Does
NearLens scans for Bluetooth Low Energy (BLE) signals and compares them against a database of known smart glasses signatures, including Ray-Ban Meta, Snap Spectacles, and similar devices. When a known device is detected nearby, the app alerts you.
All scanning, matching, and storage happen entirely on your device. NearLens does not transmit your location, scan data, or detection history to any server. See our Privacy Policy for full details.
Technical Limitations - Please Read
NearLens cannot guarantee detection of every smart glasses device. Bluetooth is an imperfect signal layer with known limitations that are outside our control.
Specifically, you acknowledge and agree that:
- Bluetooth can be disabled. A user wearing smart glasses can disable Bluetooth at any time, making their device invisible to NearLens and any other scanner.
- MAC address randomization. iOS, Android, and many firmware versions randomize Bluetooth hardware addresses by default. Randomized addresses may not match our signature database.
- Manufacturer changes. Vendors may update their Bluetooth firmware, change broadcast names, or alter advertisement packets at any time without notice. A device that NearLens detects today may go undetected after a firmware update.
- Signal range and interference. Bluetooth range varies with physical obstacles, interference from other devices, and radio conditions. A device present in the same room may not be detected if signal strength is insufficient.
- Database coverage. Our signature database covers known models at the time of each app update. New smart glasses models released after an update will not be detected until the database is updated.
- NearLens is a situational awareness tool, not a security system. It should not be used as your sole means of determining whether you are being recorded. We make no representation that use of NearLens ensures your privacy.
Acceptable Use
NearLens is built to help people understand their privacy environment. You agree not to use it to harm others. Prohibited uses include:
- Harassment, intimidation, or confrontation. You must not use detection alerts as a basis to harass, threaten, approach, or physically confront any individual.
- Stalking or surveillance. You must not use NearLens to track the movements or activities of individuals over time.
- Automated retaliation systems. You must not integrate NearLens output into automated physical security, access-control, or retaliation systems.
- Reverse engineering the detection database. You must not extract, copy, or attempt to reconstruct the proprietary Bluetooth signature database embedded in the app.
- Illegal purposes. You must not use NearLens in any manner that violates applicable laws or regulations in your jurisdiction.
We reserve the right to revoke your license if we become aware of a prohibited use.
Disclaimer of Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The app will detect every smart glasses device in your vicinity
- The app will be error-free, uninterrupted, or always available
- Detection results are accurate, complete, or current
- Any defects will be corrected
Some jurisdictions do not allow the exclusion of implied warranties. To the extent such warranties cannot be excluded under applicable law, they are limited to the minimum duration permitted.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEARLENS AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of privacy or unauthorized recording by an undetected device
- Any action you take, or fail to take, based on a detection alert or the absence of one
- Losses arising from app unavailability, detection errors, or database gaps
- Any third-party claims related to your use of the app
Because NearLens is a free app, our total aggregate liability to you for any claim arising out of or related to these terms or your use of the app is limited to CAD $0.00 - the amount you paid for the app.
Some jurisdictions do not allow the limitation of liability for certain damages. Where such limitations are not permitted by law, our liability is limited to the greatest extent allowed.
Privacy
Your use of NearLens is also governed by our Privacy Policy, which is incorporated into these terms by reference. The short version: the app collects no personal data. All detection processing stays on your device.
This website (nearlens.app) uses Google Analytics only with your explicit consent. You can manage or withdraw that consent at any time using the shield icon at the bottom-left of any page.
Apple App Store Terms
NearLens is distributed through the Apple App Store. The following applies to your use of the app on Apple devices:
- These terms are between you and NearLens only. Apple is not a party to these terms and is not responsible for NearLens or its content.
- Apple has no obligation to provide maintenance or support for NearLens. Any maintenance and support is our responsibility alone.
- Apple is not liable for any claims you have related to NearLens, including product liability, consumer protection, or intellectual property claims.
- Apple is a third-party beneficiary of these terms and may enforce them against you upon your acceptance.
- Your use of NearLens must comply with the Apple App Store Terms of Service.
Termination
This license is effective until terminated. Your rights terminate automatically, without notice from us, if you breach any term of this agreement. Upon termination, you must stop using NearLens and delete all copies from your devices.
You may also stop using the app at any time by deleting it. Termination does not affect any rights or liabilities that arose before the termination date.
Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada. If you are a consumer in a jurisdiction where local law grants you additional rights, those rights are not waived by this clause.
Changes to These Terms
We may update these terms from time to time. When we do, the effective date at the bottom of this page will change. For material changes, we will make reasonable efforts to notify you, such as through an in-app notice or an update to the App Store listing. Continuing to use NearLens after a change takes effect constitutes your acceptance of the new terms.
